These Terms & Conditions (“Terms”) govern your use of www.arohika.com and purchases from Arohika’s Art (“Arohika,” “we,” “us,” or “our”). By using this website, placing an order, or requesting a commission, you agree to these Terms. If you do not agree, please do not use the website or place an order.
About Arohika’s Art
Arohika’s Art is an independent art studio based in Bothell, Washington, USA. Questions about these Terms or an order may be sent to shop@arohika.com.
Website Use
You may use this website only for lawful purposes and in a way that does not interfere with its operation, security, or availability. You may not attempt to gain unauthorized access to the website, introduce malicious code, scrape or copy content in violation of these Terms, impersonate another person, or use the website for fraudulent activity.
You must be legally capable of entering into a binding agreement to place an order. If you use the website on behalf of an organization, you represent that you are authorized to bind that organization.
Artwork and Product Information
We make reasonable efforts to describe and photograph each artwork and product accurately. Because original artwork is handmade and one of a kind, minor variations and natural characteristics are part of the work. Colors and scale may also appear differently depending on lighting, photography, screen settings, and device. Measurements are approximate unless expressly stated otherwise.
Frames, display props, and room-scene elements shown in photographs are not included unless the product description specifically says they are included. Please review the complete listing and contact us before ordering if a particular detail is important to your purchase.
Pricing, Payment, and Taxes
Prices are shown in U.S. dollars unless otherwise stated. Applicable taxes and shipping charges are calculated or displayed during checkout. We may correct typographical, pricing, or product-information errors before accepting or fulfilling an order. If a correction materially affects an order already placed, we will contact you and, when appropriate, offer the option to cancel for a refund.
Payments are processed through WooPayments and the payment method or digital wallet you select. Your payment provider may apply its own terms, privacy policy, currency-conversion charges, or other fees. An order confirmation acknowledges that we received your order; it does not prevent us from canceling and refunding an order that cannot be fulfilled, appears fraudulent, contains a material error, or violates these Terms.
Availability and Order Acceptance
Original artworks are unique and may occasionally sell through another channel before website availability is updated. Products may also be limited, discontinued, or unavailable. If we cannot fulfill an order, we will notify you and refund the affected amount to the original payment method.
We reserve the right to limit or decline orders where reasonably necessary to protect the studio, customers, or website, including suspected fraud, payment problems, inventory errors, abusive conduct, or misuse of promotions.
Commissions and Personalized Products
Commissioned artwork and personalized products may require reference photographs, written details, preferences, approvals, or other materials from you. You represent that you own or have permission to use and provide all submitted materials and that our use of them to complete your order will not violate another person’s rights.
Project scope, dimensions, price, payment schedule, estimated timing, included revisions, delivery method, and other special terms may be stated in a product listing, proposal, invoice, or written communication. Those specific terms become part of these Terms for that project. If they conflict with these general Terms, the specific written project terms control.
Where a proof or approval is requested, you are responsible for reviewing it carefully and responding promptly. Delays in providing information or approval may change the estimated completion date. Once work has begun or a personalized item has been produced, changes may be limited or may require an additional charge.
Custom, commissioned, and personalized products are final sale except where they arrive damaged, are materially defective, or do not match the approved specifications because of our error. This does not limit any rights that cannot legally be waived.
Shipping and Delivery
Current processing estimates, shipping methods, geographic limits, and other delivery information appear on our Shipping & Returns page and applicable product pages. Processing and delivery dates are estimates, not guarantees. Carrier delays, weather, customs, address problems, holidays, or events outside our reasonable control may affect delivery.
You are responsible for providing a complete and accurate delivery address. Additional shipping or handling costs caused by an incorrect address, refused delivery, or unclaimed package may be charged where permitted. Risk of loss and legal title pass as provided by applicable law; nothing in these Terms removes rights that applicable consumer law gives you.
International customers are responsible for customs duties, import taxes, brokerage charges, and local requirements unless checkout expressly states otherwise.
Returns, Exchanges, and Refunds
Return eligibility and instructions are described on our Shipping & Returns page. At present:
- Original paintings, commissioned works, and personalized products: final sale except for damage, material defect, or our fulfillment error.
- Eligible fine art prints: contact us within 10 days of delivery to request a return or exchange. Items must be returned in their original condition and protective packaging.
Do not send a return without contacting us first. Unless the return is due to damage, defect, or our error, the customer is responsible for return-shipping costs. Original outbound shipping charges are not refundable unless required by law or the return is caused by our error. We recommend tracked return shipping because we cannot issue a refund for an item we do not receive.
Approved refunds are sent to the original payment method after the returned item is received and inspected. Bank processing times vary. We may reduce or decline a refund where an item is returned late, used, damaged after delivery, or missing original components, to the extent permitted by law.
Damaged, Defective, or Incorrect Orders
Please inspect your order promptly after delivery. If it arrives damaged, materially defective, or incorrect, contact shop@arohika.com as soon as reasonably possible with your order number, a description of the issue, photographs of the item, and photographs of the packaging. Keep the item and packaging until we provide instructions, since the carrier may require them. We will work with you on an appropriate replacement, repair, or refund based on the circumstances and applicable law.
Promotions, Coupons, and Gift Cards
Promotions, coupon codes, credits, and gift cards may be subject to additional terms stated with the offer. Unless stated otherwise, promotions cannot be combined, applied retroactively, redeemed for cash, or used after expiration. We may correct or cancel a promotion affected by error, fraud, or abuse, subject to applicable law.
Intellectual Property
The website and its artwork images, photographs, designs, text, graphics, logos, videos, and other content are owned by Arohika’s Art or used with permission and are protected by intellectual-property laws. Buying an original artwork, print, or commissioned piece transfers ownership of the physical item only. It does not transfer copyright or reproduction, merchandising, publication, digital-distribution, or other intellectual-property rights unless we expressly agree in writing.
You may view the website and share links for personal, noncommercial purposes. You may not copy, reproduce, modify, sell, license, create commercial derivative works from, train a model on, or otherwise exploit website content or artwork images without prior written permission.
Your Submissions and Communications
You retain your rights in photographs, text, and other materials you submit. You grant us a limited, nonexclusive permission to access, reproduce, modify, and use those materials only as reasonably necessary to communicate with you, create and fulfill your order, maintain appropriate business records, and resolve disputes. We will not publicly feature a private reference photograph or commissioned work as promotional content without permission where such permission is reasonably expected.
Do not submit unlawful, infringing, threatening, abusive, deceptive, or malicious material, or sensitive information that is not necessary for your order.
Third-Party Services and Links
The website relies on third-party services for functions such as payments, hosting, analytics, email, and shipping. It may also link to third-party websites or social platforms. We are not responsible for third-party content, availability, or practices, and your use of those services may be governed by their own terms and privacy policies.
Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the website, you acknowledge that online systems cannot be guaranteed completely secure.
Disclaimers
To the fullest extent permitted by law, the website is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access, error-free operation, exact screen-to-artwork color matching, or that every product will remain available. Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.
Limitation of Liability
To the fullest extent permitted by law, Arohika’s Art will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or a purchase. Where liability cannot be excluded, our total liability relating to a product or order will not exceed the amount you paid for that product or order, except where applicable law requires otherwise. These limitations do not apply to liability that cannot lawfully be limited.
Indemnity
To the extent permitted by law, you agree to be responsible for losses or claims arising from your unlawful misuse of the website, your violation of these Terms, or materials you submit without the necessary rights. This provision does not apply to losses caused by our own unlawful conduct or where prohibited by applicable law.
Governing Law
These Terms are governed by the laws of the State of Washington and applicable United States federal law, without regard to conflict-of-law principles. Any dispute will be handled by a court with lawful jurisdiction. Nothing in this section prevents a consumer from relying on mandatory protections available under the law that applies to them.
Changes to These Terms
We may update these Terms to reflect changes to the website, our practices, or applicable requirements. The updated version will be posted here with a revised “Last updated” date. Changes apply prospectively unless applicable law requires otherwise.
Severability and No Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law. A delay in enforcing a provision does not waive our right to enforce it later.
